Double Apex Terms and Conditions

Welcome to Double Apex. This is the part where we explain the rules of the road. We will keep it in plain English. No legal fog. No ambushes in the footnotes. If you create an account, subscribe to our mailers, or use any account-only features on this site, these Terms and Conditions apply to you.
By creating an account or continuing to use your account, you confirm that you have read and accepted these Terms, as well as our Privacy Notice. If you do not agree, do not create an account and do not use account-based features. Simple enough.
1. Who We Are
Double Apex is an independent South African automotive publication built for people who actually care about cars. We publish automotive news, reviews, features, opinion, heritage content, motorsport stories and related editorial material. We may also offer account-based services, including newsletter subscriptions, profile and preference management, comment or community features, and other reader tools from time to time.
2. Eligibility and Age Requirement
You may only create a Double Apex account if you are 18 years of age or older and legally capable of entering into a binding agreement under South African law.
By registering for an account, you confirm that:
- you are at least 18 years old;
- the information you provide is true and accurate; and
- you are creating the account for yourself, or you have proper authority to do so.
We do not knowingly allow minors to create accounts for account-based services or editorial mailers. If we reasonably believe that an account was created by or for someone under 18 without lawful authority, we may suspend or delete that account.
3. Your Account
When you create an account, you agree to provide accurate and current information and to keep that information up to date. You are responsible for maintaining the confidentiality of your login details and for all activity that takes place through your account.
You agree not to:
- share your login credentials with others;
- impersonate another person or misrepresent your identity;
- create an account using false age information;
- use the site in a way that interferes with its normal operation; or
- use automated tools, scraping systems or abusive methods to access account-only features without our permission.
If you believe your account has been compromised, you must notify us promptly. If we believe your account presents a security risk or is being used in breach of these Terms, we may restrict, suspend or terminate access.
4. Newsletter Consent and Bespoke Editorial Mailers
Double Apex may offer you the option to subscribe to editorial email updates, including bespoke news mailers, curated roundups, new feature alerts, reviews, opinions, special editorial themes and other automotive content we believe is worth your inbox space.
These mailers are optional unless we clearly state otherwise for a specific service. By opting in, you consent to receive editorial marketing communications from Double Apex by email. That consent is voluntary, specific and recorded.
We are not interested in shady consent games. We do not treat silence as permission, and we do not assume that creating an account means you automatically want every email under the sun. If you subscribe to editorial mailers, you may unsubscribe at any time by:
- clicking the unsubscribe link in the email;
- updating your preferences in your account, where available; or
- contacting us directly and asking to be removed.
Unsubscribing from marketing or editorial mailers will not stop essential service emails that we may need to send about your account.
5. Service Emails
Even if you opt out of editorial or marketing mailers, we may still send you service-related emails where reasonably necessary. These may include account verification messages, login links, password resets, security notices, changes to important terms, technical notices and other communications directly related to your use of the account.
Those are not promotional emails. They are part of operating the account properly.
6. Personal Information and POPIA
We process personal information in line with applicable South African law, including the Protection of Personal Information Act, 2013 (“POPIA”). If you create an account or subscribe to a Double Apex mailer, we may collect and process personal information such as:
- your name or display name;
- your email address;
- your login credentials or secure login tokens;
- your communication preferences and subscription choices;
- basic device, browser and usage information;
- your interactions with our emails, site content or account features; and
- any other information you choose to provide to us.
We use this information to:
- create and manage your account;
- authenticate your access and keep the site secure;
- deliver newsletters and editorial mailers where you have consented;
- send necessary service communications;
- understand content performance and improve user experience;
- protect the site and our users against abuse, fraud or misuse; and
- comply with legal obligations where required.
We aim to collect only information that we reasonably need. We are a car site, not a surveillance hobby.
7. Your Privacy Rights

You may also object to direct marketing at any time. If you no longer want editorial mailers from us, use the unsubscribe link or contact us. We should not need a dramatic breakup speech.
8. Comments, Submissions and User Conduct
If Double Apex allows comments, profile features, user submissions or community participation, you remain responsible for what you post. You agree not to upload, submit or share anything that:
- is unlawful, defamatory, threatening, abusive or invasive of another person’s rights;
- contains spam, malicious code or deceptive links;
- pretends to be written by someone else;
- infringes any copyright, trade mark or other rights;
- amounts to harassment, hate speech or coordinated abuse; or
- damages or interferes with the site or its users.
We reserve the right to moderate, remove, restrict or refuse user content or account access where we reasonably believe it breaches these Terms, creates legal exposure, or turns the place into a circus.
9. Intellectual Property
Unless otherwise stated, all content on Double Apex, including articles, reviews, images, branding, logos, graphics, layout, editorial material, source formatting and site design, is owned by us or licensed to us and is protected by applicable intellectual property laws.
You may read, share and link to our content for personal, non-commercial use, provided you do not misrepresent the source or remove attribution. You may not copy, republish, scrape, reproduce, distribute, commercially exploit or create derivative works from our content without prior written permission, except where the law clearly allows it.
If you submit content to us, you confirm that you have the right to do so and grant us a non-exclusive, royalty-free licence to use, host, display, publish and distribute that content for purposes connected to the site and our editorial operations.
10. Editorial Nature of the Site
Double Apex publishes editorial content for informational, journalistic and enthusiast purposes. We do our best to keep things accurate and worthwhile, but the site does not provide legal, financial, insurance, mechanical repair or engineering advice tailored to your personal situation.
If you read an article about a V12 Ferrari and decide that this is the week to remap something expensive with a mate and a screwdriver, that decision remains firmly your own.
11. Availability of the Site
We do not guarantee that the site, your account, or any associated feature will always be available, uninterrupted, error-free or immune from security issues. We may update, suspend, restrict or discontinue parts of the site at any time, including account tools, newsletters, editorial products or specific features.
We will try not to break useful things for sport, but no digital platform gets to promise perfection with a straight face.
12. Security
We take reasonable technical and organisational steps to secure personal information and protect our systems. That said, no internet-based platform can promise absolute security. You are responsible for keeping your login details secure and for using the site in a sensible way.
Where a security issue affects your account or information and applicable law requires notice, we will deal with it in accordance with our legal obligations.
13. Suspension and Termination
We may suspend, restrict or terminate your account if:
- you breach these Terms;
- you provide false or misleading information;
- you misuse the site, its systems or its community features;
- we reasonably believe your account creates legal, operational or security risk; or
- we are required to do so by law.
You may stop using your account at any time. Where a deletion function is available, you may use it. You may also contact us and request closure of your account, subject to any information we are legally required or reasonably entitled to retain.
14. Limitation of Liability
To the fullest extent permitted by South African law, Double Apex will not be liable for indirect, incidental, special or consequential loss arising from your use of, or inability to use, the site or account features. This includes loss arising from site downtime, interruptions, content errors, email delays, loss of data, or third-party interference.
Nothing in these Terms excludes liability where it would be unlawful to do so. If South African law says a particular right or remedy cannot be excluded, then we are not pretending otherwise.
15. Third-Party Services and Links
The site may contain links to third-party websites, embedded media, social platforms, analytics services or external tools. Those services operate under their own terms and privacy policies, not ours. We are not responsible for the content, security or practices of third-party sites that you choose to visit.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes in the law, our services, our account features or the way we operate the site. Where the changes are material, we may notify users by email, through the account, or by posting a prominent notice on the site.
Your continued use of the account after updated Terms take effect means you accept the revised version. If you do not agree with the updated Terms, you should stop using the account and close it.
17. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or relating to these Terms, your account or your use of the site will be subject to the jurisdiction of the South African courts, subject to any rights you may have under applicable consumer law.

In return, all we ask is that you use the site honestly, respect the rules, and do not act like a chop.
